Yet Again WEMO Routes are Closed to ORVs – Update on Status of Center for Biological Diversity v. Bureau of Land Management (2006 and 2021 cases)

Continuing the years-long saga of fighting against improperly designated WEMO routes by the BLM that don’t provide for abusive OHV riding: “All routes in desert tortoise and Lane Mountain milk-vetch critical habitat are closed to  OHV recreation.”

Per the summary posted on this Wikipedia page by Steven Gjerstad:

“[T]he Court grants the following injunctive relief for the duration of the remand proceedings: 1. BLM is ordered to close all OHV routes in desert tortoise and LMMV designated critical habitat and clearly mark such routes as closed with appropriate signage and fencing as needed. BLM shall keep open designated county roads and highways, as well as any and all routes needed to provide access for established easements, administrative access, emergency access, and other permitted uses (but not public OHV recreational use).”

“The remand period will end on October 14, 2029.”

You can read the full decision here.

Per the BLM:

The BLM is taking steps to comply with the order. Beginning March 24, 2026, and until further notice:

  • All routes in desert tortoise and Lane Mountain milk-vetch critical habitat are closed to  OHV recreation. OHVrecreation includes street legal vehicles used for recreation (view map).
  • The BLM will implement a compliance monitoring program and submit semi-annual reports to the court.
